On 17th February 2005, Fr. H. Hrynkiv delivered me a decree № 458/2002a. On the base of Pastor Bonus art.123, I am appealing against the resolution of the Congregation for Oriental Churches № 458/2002a, by which the Congregation has approved the decree issued by the General Superior, OSBM, excluding me from OBSM.

The Congregation for Oriental Churches was well acquainted with the fact that Fr. B. Kovby?, General Superior OSBM, broke the legal procedure when inflicting three canonical reproofs containing definite punishments, and also that when issuing the decree of an exclusion from OSBM, the legal procedure was broken.

I brought recourses against all canonical reproofs. Against the decree of the exclusion from OSBM I brought a recourse, too. Twice I have applied to the Apostolic Signature for a trial, as to the acting of the General Superior. Once I have applied to Rota Romana for a court treatment.

These accusations against the resolution of the General Superior OSBM, Fr. Basil Kovby?, were passed to the Congregation for Oriental Churches. However, the Congregation ignored all the recourses and applications for a trial, and issued a decree confirming the exclusion from OSBM without a trial.

Thereby, I kindly ask for an annulment of all punitive decrees of the General Superior as well as for an annulment of the decree of the Congregation for Oriental Churches № 458/2002a.

I am asking for an inquiry into the whole situation and for a proper Church trial, as well as for a compensation of the moral harm I have suffered from the side of the General Superior and from the side of the Congregation for Oriental Churches.

All the necessary documents I have already sent to You as well as to the Congregation.

I have committed none of the offences for which I am punished with the exclusion from OSBM.

Up to this time I have been repeatedly rejected an opportunity to defend myself.
