Proposal of moral compensation
Post date: 2005-06-30Autor:
Your Eminence,
on 29th January 2005 I mailed by fax and on 30th January 2005 by letter a Recourse to the Congregation for the Oriental Churches against the decree of the General Superior (№ 01/05) by which I was excluded from the OSBM.
On 12th May 2005 I sent an urgency of the recourse to the Congregation for the Oriental Churches and applied for an issue of a decree according to the CCEO can. 1518.
The Congregation has not replied until this day.
In regard to AAS, LXXVIII, 1986, 1323-1324, as You write in Your letter (№ 36627/04 CA) from 15th April 2005, as well as in regard to Pastor Bonus art. 123, we kindly ask the Supreme Tribunal of the Apostolic Signature for a service of the court.
1) I ask for an annulment of all three canonical reproofs and for an annulment of the decree of exclusion from the OSBM issued against me by the General Superior.
2) I kindly ask You to consider the following: I propose moral compensation in a form of positive proclamation by the OSBM authorities:
Thereby the Generalate OSBM confirms that the religious priests with perpetual vows, who apply for a transition from the OSBM into another form of religious life (another order, monastery sui iuris…), committed no transgression of religious vows and so they are blameless. We comply with their application and this letter is simultaneously a positive reference for the below-mentioned religious:
Fr. Metod?j R. Špi?ík, ThD., OSBM born: 1968
perpetual vows: 1996
Fr. Eliáš A. Dohnal, ThD., OSBM born: 1946
perpetual vows: 1996
Fr. Cyril J. Špi?ík, ThD., Ing., OSBM: born: 1966
perpetual vows:1996
Fr. František L. Juchelka, ThD., Ing., OSBM: born: 1968
perpetual vows: 1966
Fr. Markian V. Hitiuk, ThLic., OSBM born: 1970
perpetual vows: 1996
Fr. Roman V. Šelepko, ThLic., OSBM born: 1969
perpetual vows:1996
