Your Eminence, I thank for Your letter from 25th October 2005.

 

1)   The very fact that You do not have (as Your Eminence writes in Your letter) my standpoint regarding my exclusion from the OSBM Order as well as my defence, unquestionably testifies that my exclusion and the acknowledgement of this exclusion were incompatible with the CCEO.

According to the CCEO can. 500 §2 pt.3 and §3 and CCEO can. 1486 §1 every exclusion from an order must be preceded by two canonical reproofs whereby: “the reasons for exclusion must be brought to the notice of the member in a written form,  after each notification givng him a full opportunity to defend himself” and “the replies of the member in a written form are put to acts…”! A verbal discussion between the superior and the defendant “must take place in the presence of a promoter of justice and a notary”! None of the above-mentioned conditions necessary to a legitimacy of the punitive decrees and the decree of exclusion from the OSBM, as testified by the Congregation for the Oriental Churches itself in the letter from 25th October 2005, was observed by our superiors! ...
